These Terms of Use ("Terms") are an agreement between you and Atarly ("we", "us", "our") covering your use of the Atarly mobile application ("App"). By creating an account or using the App you agree to these Terms and to our Privacy Policy.
If you are under 18, you confirm that a parent or guardian has reviewed these Terms with you and consents to your use of the App, including any purchases. You must be at least 13 years old to use the App.
If you do not agree, do not use the App.
Atarly is a study-planning and wellbeing tool for VCE students: a study timer, calendar, task manager, score tracking, ATAR estimation, and social features.
We are an independent developer team. We are NOT affiliated with, endorsed by, or connected to the Victorian Curriculum and Assessment Authority (VCAA), the Victorian Tertiary Admissions Centre (VTAC), ACARA, or any school, university, or government body.
This is the important one, so we'll say it plainly: ATAR predictions, study-score estimates, "scores needed" calculations and study plans generated by the App are ESTIMATES based on the numbers you enter and publicly available historical scaling data. They are provided for motivation and planning only.
They are not academic advice, not a promise, and not an official prediction. Actual ATARs and study scores are determined solely by VCAA and VTAC and depend on many factors the App cannot know. Do not make enrolment, subject-selection or other significant decisions based only on the App's numbers. Using the App does not guarantee any improvement in results.
You need an account for social features, cloud backup and subscriptions. You agree to provide accurate information and to keep your login details secure — you are responsible for activity on your account.
One account per person, and an account may be actively signed in on one device at a time: signing in on a new device signs the previous one out. Don't share your account. We may suspend or close accounts that break these Terms.
The only things other users ever see from you are your display name, your @username, your profile photo (if you set one), your points, and your school (if you leave "Show my school" on). Your scores, journal, tasks and calendar are never visible to anyone else.
You are responsible for what you put in those fields. You agree that your display name, @username and profile photo will not be:
We filter obvious profanity automatically and reserve the right to rename, hide, or remove any username, photo or account that we consider (at our sole discretion) to breach these rules — with or without notice.
There is ZERO TOLERANCE for objectionable content or abusive behaviour on Atarly. We take this seriously because our users are school students.
If you see a display name or profile photo that breaches these Terms, report it: open the person's profile from the Friends or Leaderboard screen and use Report. Choose a reason (name, photo, or other) and add detail if you want.
Our commitment: we review every report and act on breaching content within 24 hours — removing or renaming the content and, where warranted, suspending or permanently banning the account responsible. Users we eject for abusive behaviour are not welcome back.
Reporting is confidential — the reported user is never told who reported them. Filing deliberately false or malicious reports is itself a breach of these Terms and may cost you your account.
If you believe you are in danger or a crime has occurred, contact your local police. In Australia, Kids Helpline (1800 55 1800) and Lifeline (13 11 14) are free, confidential and available 24/7.
Premium features ("Locked In") are sold as an auto-renewing subscription through Apple's App Store: A$8.99 per month or A$64.99 per year (prices in other regions are set by Apple; the exact price is always shown before you buy).
The monthly plan may include a one-week free trial for new subscribers. Trials convert to a paid subscription automatically unless you cancel at least 24 hours before the trial ends — cancelling keeps your access for the remainder of the trial.
Subscriptions renew automatically until cancelled. Billing, renewal, cancellation and refunds are handled entirely by Apple: manage or cancel anytime in iOS Settings → your name → Subscriptions, or via the Manage Subscription screen in the App. Deleting the App or your account does NOT cancel a subscription.
How auto-renewal works, in full: payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period. Any unused portion of a free trial is forfeited when you buy a subscription.
If we ever change the price of a subscription, Apple will notify you and ask you to agree before the new price takes effect. If you don't agree, the subscription simply stops renewing.
Refunds are subject to Apple's refund policies (requested through Apple at reportaproblem.apple.com, not us), and nothing in these Terms limits your rights under the Australian Consumer Law.
Each account gets a referral code. When a new user redeems your code, both accounts receive one week of complimentary Locked In access. Codes can be redeemed by a maximum of 2 accounts, and each account may redeem only one code, ever.
Referral rewards have no cash value, can't be transferred or stacked indefinitely, and we may modify or withdraw the referral program at any time. We may revoke rewards obtained through fake accounts, self-referral or other abuse.
The core of the App (study timer, streaks, tasks, calendar, daily check-in, predicted ATAR, the Forecast calculator, and social features) is free. We intend to keep it that way, but we may change which features are free and which are premium over time. Changes won't remove access you've already paid for during a paid period.
You own the information you put into the App (scores, tasks, journal entries, photos). You grant us a limited licence to store and process it purely to operate the App — syncing it to your account, showing your points on leaderboards you participate in, and so on. See the Privacy Policy for full details on data handling.
You can delete your account (Settings → Delete account) at any time, which permanently removes your account data from our systems.
You agree not to: attempt to access other users' data; probe, disrupt or overload our systems; reverse-engineer, copy or resell the App; use automation or exploits to manipulate points, leaderboards, referral rewards or achievements; or use the App for anything unlawful.
Points and leaderboards exist for motivation — if we find manipulated numbers we may reset them or suspend the account.
The App, its design, branding, code and content (excluding your data) belong to Atarly. You get a personal, non-transferable licence to use the App on your Apple devices in line with these Terms and Apple's standard licence terms. You may not copy, modify, distribute or create derivative works from the App.
The App relies on third-party services to function: Apple (App Store, payments, Sign in with Apple, iOS frameworks), Google (Sign in with Google, if you use it), Supabase (accounts and data storage), RevenueCat (subscription management), PostHog (product analytics) and Resend (account emails). Their processing of your data is described in our Privacy Policy. We are not responsible for outages of third-party services, though we'll always do our best to keep the App working.
We use PostHog to record a small set of product-usage events — completing signup, paywalls being shown and their outcome, and the screens you visit — so we can see what's working and what's broken.
We never send your academic data, journal entries, mood or sleep ratings, points values, email, username, or any financial information to analytics. We do not track you across other apps or websites, and we do not sell your data. Full detail is in the Privacy Policy under "Product analytics".
Atarly includes wellbeing features — sleep and mood ratings, balance reviews, break reminders and a journal. These are self-reflection tools to help you study sustainably. They are NOT medical, psychological or health advice, and no part of the App diagnoses, treats or monitors any condition.
If you are struggling with your mental health, please talk to a doctor, your school wellbeing team, or a parent or guardian. In Australia: Kids Helpline 1800 55 1800, Lifeline 13 11 14, Beyond Blue 1300 22 4636. In an emergency call 000.
Focus Mode uses Apple's Screen Time (Family Controls) frameworks to restrict apps you personally select while you study. You choose what to block, blocking only runs during sessions you start, and you can end a session or remove restrictions at any time from the App or iOS Settings → Screen Time.
You are responsible for what you choose to block. Do not block apps you may need to reach in an emergency — the App cannot and does not block your phone's ability to make emergency calls, but you should not rely on Focus Mode behaving any particular way in an urgent situation. We are not liable for anything you miss while a session you started is running.
These Terms are between you and Atarly only — NOT with Apple. Apple is not responsible for the App or its content.
The App is provided "as is". To the maximum extent permitted by law, we exclude all implied warranties and are not liable for indirect or consequential loss — including academic outcomes, lost data caused by factors outside our control, or decisions made in reliance on the App's estimates.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited (at our option) to re-supplying the service or refunding the amount you paid us in the previous 12 months.
You can stop using the App or delete your account at any time. We may suspend or terminate accounts that breach these Terms, and may modify or discontinue features (or the App itself) — if the App were ever discontinued, active paid periods would run their course or be handled per Apple's policies.
We may update these Terms as the App evolves. Material changes will be flagged in the App, and the "last updated" date always tells you the current version. Continuing to use the App after changes means you accept them.
Our Privacy Policy explains what we collect, how it's stored, who processes it, and the rights you have under the Australian Privacy Act 1988 (Cth). It forms part of these Terms — by agreeing to these Terms you also agree to the Privacy Policy. You can read it any time in Settings, or at atarly.app/privacy.
To the extent permitted by law, you agree to reimburse us for any loss, damage or cost we suffer arising from your breach of these Terms, your misuse of the App, or content you provide that infringes someone else's rights or breaks the law. This does not apply to anything caused by our own breach or negligence, and it does not limit your rights under the Australian Consumer Law.
If any provision of these Terms is found to be invalid or unenforceable, it is severed and the rest continues to apply in full. If we don't enforce a right straight away, that isn't a waiver of it.
We are not liable for failures caused by things genuinely outside our control — outages at Apple, Supabase or other providers, network failures, natural disasters, or changes in the law.
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App. You may not transfer your rights under them; we may transfer ours if the App changes hands, and we'll tell you in the App if that happens.
These Terms are governed by the laws of Victoria, Australia, and any disputes belong to the courts of Victoria. If you live outside Victoria, you may still have the benefit of mandatory consumer protections in your own jurisdiction — nothing here removes those.
